1. Acceptance of Terms and Conditions

1.1

Please read these terms carefully before booking our classes. These terms outline who we are, how we will provide classes, how you and we may modify or terminate the contract, and other important information. If you think there is an error in these terms, please contact us to discuss.

1.2

All individuals wishing to attend a Happy Hoops class must agree to the terms and conditions set out below. The Terms are considered accepted by the Parent upon payment of the Fee by or on behalf of the Parent. Payment by the Carer is deemed to be made on behalf of the Parent.

1.3

These terms and conditions govern the provision of Happy Hoops classes to you. No variation or addition to the Terms will be binding unless agreed in writing by Happy Hoops and the Parent.

1.4

All agreements relating to the teaching of the class by Happy Hoops to the Pupil are subject to these Terms to the exclusion of any other terms and conditions.

1.5

If a customer fails to comply with these terms and conditions, they may be asked to discontinue classes with Happy Hoops. In such cases, Happy Hoops is under no obligation to provide a refund for any outstanding lessons.

1.6

The Parent and/or Carer agrees to keep the content of Happy Hoops classes confidential and not to replicate or use any aspect of the classes directly or indirectly. The Parent and/or Carer also agrees not to manage, operate, or assist in organizing any business that competes with Happy Hoops during their membership and for a period of two years afterward.

2. Information About Head Office and How to Contact Us

2.1

Happy Hoops Franchise Limited is a company registered in England, number 10582027. Our registered office address is Henry Brake House, 46 Hullbridge Road, South Woodham Ferrers, Chelmsford, Essex, England, CM3 5NG.

2.2

For specific inquiries about your Happy Hoops class, contact us directly via email at happy_hoops@outlook.com.

2.3

If we need to contact you, we will do so by text message (including WhatsApp), phone, or email at the address or phone number provided at the time of booking.

3. Booking, Payment & Cancellation

3.1 Booking a Class

3.1.1

Class bookings can be made online through your local Happy Hoops provider’s dedicated website.

3.1.2

You must provide certain personal information to book a class. Details of what we collect are outlined in our Data Privacy Policy: https://happyhoops.com/privacy-policy.

3.1.3

During booking, you will be required to read and accept these Terms and Conditions. Upon completion, you will receive a confirmation email with details of your booking, class times, location, and other relevant information.

3.1.4

Class timetables are accurate at the time of publishing. If changes are made to the time or location of your class, your local provider will inform you.

3.1.5

All prices include VAT where applicable.

3.2 Payment

3.2.1

Lessons are paid for monthly in advance. Payment must be made in full before the Pupil begins the course. Your first payment includes the first month of fees and a Membership Fee. Subsequent monthly payments are automatically deducted on the 1st of every month, adjusted for any credits such as canceled lesson credits.

3.2.2

You authorize Happy Hoops to take automatic monthly payments until you give 30 days’ written notice to cancel. Payments will be taken from the same card used for the initial payment unless you update your card details with your local provider.

3.2.3

Ensure that sufficient funds are available and your card is valid. If an automatic payment fails, you will be notified, and two further attempts will be made. If unsuccessful, you will lose your place in the class and be responsible for any fees incurred.

3.2.4

Fees are non-refundable unless agreed upon in writing by Happy Hoops, except if the child attends their first class and gives written notice within 24 hours of that class stating they will not continue. In such cases, the course fees (excluding the Membership Fee) will be refunded within 30 days.

3.2.5

No refunds or credits will be given for class cancellations due to “Acts of God” (e.g., extreme weather, earthquakes), strikes, terrorism, or public health guidance advising suspension of classes.

3.2.6

If your class fee changes, you will be notified by your local Happy Hoops provider.

3.2.7

Birthday Parties and Holiday Courses are separate from regular classes. Payment for these events will not affect regular monthly payments.

3.2.8

When paying online, we accept Visa Credit, Visa Debit, MasterCard Credit, MasterCard Debit, Visa Electron, and JCB.

4. Cancellation by Happy Hoops

4.1

Happy Hoops may cancel this contract at any time before the Pupil begins the course for any reason. We will not be liable for any loss or damage arising from such cancellations.

4.2

In the event of last-minute changes or cancellations, we will notify you as soon as possible. We will not reimburse expenses for missed notifications.

4.3

If a class is canceled by Happy Hoops, you will receive a credit for the value of the canceled lesson.

4.4

If insufficient children are booked into your class, we reserve the right to cancel the class, offering either an alternative class or a refund for the remaining sessions.

4.5

In the event of cancellation prior to the course’s start, Happy Hoops will refund any fees within 30 days.

4.6

Sessions are ongoing and should be used consecutively. No credits or refunds will be issued for missed classes.

5. Attendance

5.1

Your payment reserves your place in the class. We cannot provide refunds for missed lessons. Notify us at least 48 hours in advance if you cannot attend.

5.2

If your circumstances change, please inform your local provider to confirm your attendance. Do not turn up without notice if the lesson is full, as your child may not be able to participate due to insurance reasons.

5.3

You may use the "Send-a-Friend" option to allow another child to attend in your place, subject to availability. The substitute must be the correct age for the class.

6. Cancellation by Parent/Carer

6.1

Statutory cancellation rights do not apply to our classes.

6.2

New customers may receive a refund if they attend their first session and notify us within 24 hours in writing that they will not continue.

6.3

Existing customers may cancel with 30 days' written notice, but no refund or credit will be given for unattended classes.

7. Parent’s Responsibility

7.1

The Parent warrants that the information provided is accurate and will notify Happy Hoops of any changes.

7.2

Parents must inform Happy Hoops of any condition that may affect their child’s participation.

7.3

The Parent is responsible for the welfare and behavior of their child during the class.

7.4

Customers must behave respectfully towards coaches and others. Happy Hoops reserves the right to exclude customers for unacceptable behavior.

8. Complaint’s Procedure

8.1

If you are unhappy with our service, please follow our complaints procedure:

  • Speak with the Coach or contact your local Happy Hoops provider.
  • If unresolved, send a written complaint to your local provider.
  • If still unresolved, submit your complaint to the Director at Happy Hoops Franchise Ltd. via happy_hoops@oulook.com
